Companies do not have to post their jobs. They can hire whomever they please. They must follow EOE rules and may have some hiring guidlines if they receive federal dollars or are fullfilling a federal contract. Publicly or privately held, they can hir who the want... Public agencies however are a different matter...

That is weird especially since public companies have to post their jobs. So even if someone they really wanted came to them and they wanted to hire them, if they have nothing currently available they still have to post whatever job they are hiring for, and go through the interview process, etc.

I doubt that would happen in a week.

A good lawyer (that's not an oxymoron...:) would be able to give some teeth to the fact that if they have a signed non-compete with you, it is a 2-way contract. et al,"You get to work here under _xyz___ circumstances and in exchange, you must sign this agreement." Variance on their part would likely be seen by the courts as a breach of that aggreement and may nullify their position. I'd be checking it out...

It would seem after a week they would start cutting more percentages off salaries. It's nice to see a company "ease" up on non-competes during a salary restructure. It happens in many industries.

The week window sounds kind of odd...and while not being a legal eagle with a license to steal...I would venture to say that a decent judge and or jury would view such action as perhaps voiding the entire non com clause.... but then again who knows... This is a very strange situation if true.

Maybe your post will include some details on the across the board pay cuts at Peak today (10%) and the news that they are giving air staff a week to secure local employment with other clusters with a get out of jail free card on the non-compete agreements. After the week we heard they would enforce the non competes. Question is: What happens after a week if you do not find a job?
